At first glance one would wonder what the association was between cerebral palsy (which is a problematic condition that a child has) and a lawyer. Unfortunately many cerebral palsy cases are due to medical negligence on the part of doctors and mistakes that hospitals make during the birth of the child. If the child is left too long in the birth canal or if the umbilical cord is around the neck, vital life sustaining oxygen is cut off and the child pays the price of suffering from cerebral palsy. Some doctors use forcep delivery and incorrect use could lead to brain damage. Untreated jaundice could lead to large amount of bilirubin being accumulated, which could damage the brain. As the primary duty of the doctors and nurses is to ensure safe delivery and good postnatal care, the onus of responsibility is on them. If the child has seizures or contractions, requires an MRI or a CT scan immediately after birth, or requires the use of oxygen, the chances that this could be an offshoot of incorrect delivery by the doctor concerned is very much on the cards.

Wherever there is scope for medical malpractice or negligence, the issue could become a legal one. The child with cerebral palsy is left with irreversible brain damage. If parents feel that the medical fraternity needs to be held accountable, they can seek the help of lawyers who will then file lawsuits. These lawyers will first determine whether there was any failure on the part of the physician or surgeon and if they find evidence that the error was a medical one, the lawyers will take suitable action. The parent of the child is then entitled to compensation if medical negligence is proved.

The amount of compensation will vary from case to case and an experienced lawyer can get you the kind of compensation that you are actually entitled to. Although this by no means can undo the damage that has been done to the child's brain, the doctors will be more careful in future. It will also ensure that the child gets the medical attention that it requires.
